6. Complaints

6.1. If you would like to comment or complain about any aspect of Wesleyan Bank's business or services, please contact the Banking Team Manager on 0800 358 1122, and we will endeavour to resolve the issue for you. If you are still not satisfied, you may be entitled to refer your complaint to the Financial Ombudsman Service.

Alternatively you can submit your complaint via the Online Disputes Resolution here, who will forward your complaint onto the Financial Ombudsman Service. Complaining to the Ombudsman won't affect your legal rights.

7. Compensation

7.1. Wesleyan Bank is covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to claim compensation from the scheme in the unlikely event that we cannot meet our obligations to you. This depends on the type of business we conduct with you and the circumstances of the claim. Further information about the compensation scheme arrangements is available from the FSCS by visiting their website, by email or by writing to the FSCS at PO Box 300, Mitcheldean, GL17 1DY.

8. Money laundering

8.1. Like other financial organisations, we are legally obliged to collect and record information confirming customer identity and to report details of suspicious transactions to the National Crime Agency (NCA).

13.6. Nothing in these Terms and Conditions shall be construed as excluding or limiting the liability of Wesleyan Bank for death or personal injury caused by its negligence or for any other liability which cannot be excluded by English law.

13.7. Where you deal as a consumer, nothing in the above exclusions affects your statutory rights.

Nothing in these Terms and Conditions shall exclude or restrict our duties and liabilities to you under applicable law including, without limitation, the Financial Services and Markets Act 2000 and the rules of the Financial Conduct Authority for the conduct of business and the Prudential Regulation Authority for the responsibility of the prudential regulation.

14. Privacy policy

If you provide information to Wesleyan Bank on or through the Site, Wesleyan Bank will use it in accordance with the terms of its Privacy policy. That Privacy policy forms part of these Terms and conditions and by using the Site you acknowledge and agree that you accept the terms of that Privacy policy.

 

15. General

15.1. These Terms and Conditions (as amended from time to time) constitute the entire agreement between you and Wesleyan Bank concerning your use of this Site and supersede any previous arrangement, agreement, undertaking or proposal, written or oral between you and Wesleyan Bank in relation to such matters. Wesleyan Bank reserves the right to update these Terms and Conditions from time to time. If it does so, the updated version will be effective as soon as it is uploaded on to this Site and your continued use of this Site will constitute your acceptance of such updated Terms and Conditions. No other variation to these Terms and Conditions shall be effective unless in writing and signed by an authorised representative on behalf of Wesleyan Bank. You should check the Terms and Conditions periodically to ensure that you are aware of and complying with the current version.

15.2. These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts.

15.3. If any provision(s) of these Terms and Conditions is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.

15.4. Wesleyan Bank’s failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Wesleyan Bank in writing.

15.5. Unless otherwise expressly stated, nothing in the Terms and Conditions shall create any rights or any other benefits whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise in favour of any person other than you and Wesleyan Bank.
